Packing and Marking

Goods, as per Point no. 1, are to be packed in standard paper bags of 30 kgs each or in standard wooden containers as per requirement of the buyer. Marking is to by done only in English as per instruction of the Buyer.

Terms of delivery

The Buyer pays for the trans­port and the Seller arranges for ordering and loading in the closed railway wagons. The first shipment should be done within 20 days from the date of signing of this contract and the total shipment is to be completed within 60 days from the date of signing the cont­ract, not latter than 31 July'97.

The Seller will inform buyer as soon as he loads the goods in the wagon and also informing the details of railway bill number type of synthetic rubber and quantity in each wagon.

The quantity of synthetic rubber being delivered to the buyer is fixed as per the railway bills. The Seller is respondible for the goods upto port Odessa. Partial shipment allowed in full wagon loads.

Claims

The Buyer has the right to claim any shortage in quantity of the goods within 60 days of the goods reaching the Indian port quantity the loss incurred including the

убытков, нанесен­ных во время транспортиров­ки товара, согласно

страхов­ке, в случае подтверждения компетентной Индийской ор­ганизацией.

Покупатель может предъ­явить претензию по качест­ву товара в любой момент до истечения срока годности согласно сертификату качес­тва, выданного производите­лем, равную убытку, поне­сенному покупателем, плюс таможенная пошлина, транспортировка и страхов­ка, в случае подтверждения компетентной Индийской организацией.

Покупатель обязан хранить товар согласно инструкциям, выданным производителем.

Штрафы и разрешение споров

В случае, если Продавец не поставляет товар вовремя, Продавец обязан оплатить штраф в размере 0,1% от не-поставленного товара, но не больше 10% от общей суммы непоставленного товара. Опла­та штрафных санкций не ос­вобождает Стороны контрак­та от выполнения своих обязательств по настоящему кон­тракту.
